Terms and Conditions (T&Cs) – Walking Tours Australia

1. Introduction and Core Services

These Terms and Conditions govern your booking and participation in our walking tours. By registering for or attending any tour, you agree to these terms.

Paid / Select Tours: Bookings are confirmed only upon receipt of a confirmation number or invoice issued by the Operator. Prices are in Australian Dollars (AUD) and inclusive of 10% GST.

Free / Pay-What-You-Wish Tours: Participation is based on voluntary, tip-based remuneration at the end of the tour. Pre-booking is highly recommended to secure a place.

Group Limits: Free tours are designed for individual travellers and small groups. Groups of 10 or more people (including school or tertiary groups) cannot join free tours via separate registrations and must book a Private Tour.

2. Cancellations, Amendments and Refunds

Our refund policy strictly complies with the Australian Consumer Law (ACL) consumer guarantees.

Paid General Public Tours:

• Cancellations made more than 24 hours before the scheduled tour departure are entitled to a 100% refund or a free date change.
• Cancellations made within 24 hours of the departure time, late arrivals, or no-shows are strictly non-refundable.

Private Tours:

• Cancellations made 7 days or more before the activity: 100% refund.
• Cancellations made between 3 and 7 days before the activity: 50% refund.
• Cancellations made within 72 hours (3 days) or no-shows: Non-refundable.

Weather Policy: Tours operate “rain or shine” under normal conditions. If the Operator is forced to cancel a tour due to extreme/dangerous weather or safety conditions, a 100% refund or an alternative date will be provided. No further compensation claims will be accepted.

Punctuality: Paid tours depart strictly on time. For Private Tours, if the group is more than 15 minutes late without communication, the tour will be deemed a no-show and cancelled without refund.

3. Participant Responsibilities and Safety

Inherent Risks: Participants acknowledge that walking tours involve inherent physical activities and navigation of public spaces, bars, or restaurants. It is the participant’s responsibility to wear appropriate footwear, dress for weather conditions, and bring adequate hydration.

Conduct and Guiding Instructions: You agree to follow the safety instructions of the tour guide at all times. The Operator reserves the right to refuse service or remove any participant from a tour if their behavior is disruptive, dangerous, or illegal (including excessive alcohol intoxication during pub/bar crawls).

Age Restrictions:

• Minors under 16 years must be accompanied by a parent or legal guardian.
• For any tour involving alcohol consumption (e.g., Secret Bar Tours or Pub Crawls), participants must be 18 years of age or older and present a valid government-issued photo ID (Passport, Australian Driver’s License, or Proof of Age card) upon request.

4. Limitation of Liability (Australian Consumer Law Compliance)

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010).

To the maximum extent permitted by law, the Operator’s liability for a breach of any non-excludable statutory guarantee is limited to supplying the services again or refunding the cost of the services.

The Operator is not liable for any personal injury, property damage, loss, or emotional distress arising from acts that are accidental, negligent actions of third parties (such as public venues visited), or circumstances beyond our reasonable control, except where caused by our gross negligence.

5. Privacy and Personal Data

Any personal information collected during the booking process (name, email, phone, dietary requirements, or payment details) is handled in accordance with the Privacy Act 1988 (Cth).

Your data will only be used to facilitate your tour booking, process payments securely, and—subject to your explicit opt-in consent—send marketing communications. We do not sell or share personal information with third parties for their independent marketing purposes.

6. Governing Law

These Terms and Conditions are governed by the laws of the State or Territory in Australia in which the specific tour takes place (e.g., Queensland, New South Wales, Victoria). Any disputes will be subject to the exclusive jurisdiction of the courts of that State/Territory.
